PURCHASING RULES

  • 1. General Provisions
    1.1. These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the ‘Terms and Conditions’) are a binding legal document for the parties. They contain the rights and obligations of the Buyer and the Seller, the terms for the purchase, delivery and return of goods, the payment procedure, the parties’ liability clauses, and other provisions relating to ordering and buying goods at the nukas.lt e-shop.
    1.2. All legal and natural persons of full age are entitled to buy at the nukas.lt e-shop.
    1.3. By accepting the Terms and Conditions, the Buyer warrants that, following Clause 1.2 hereof, they are entitled to buy goods at the nukas.lt e-shop.
    1.4. The contract between the Buyer and the Seller is deemed to be concluded when the Buyer clicks the button ‘Confirm Order’, after having created a shopping cart at the e-shop, indicated the delivery address, selected the payment method and read the Seller’s Terms and Conditions (see Clause 5 ‘Ordering Goods, Prices, Payment Procedure, and Terms’).
    1.5. Each contract concluded between the Buyer and the Seller is stored at the nukas.lt e-shop.

    2. Data Protection
    2.1. The Buyer may order goods at the nukas.lt e-shop by registering and entering the data requested during the registration process.
    2.2. When registering at the nukas.lt e-shop, the Buyer must provide correct personal information. The Buyer is responsible for providing the correct data.
    2.3. By accepting these Terms and Conditions, the Buyer consents to the processing of the personal data provided by the Buyer to sell goods and services at the nukas.lt e-shop, the analysis of the Seller’s activities, and direct marketing. The Buyer also agrees to receive information notes to the e-mail address and telephone number provided by the Buyer, necessary to complete the order.
    2.4. By registering at the e-shop and ordering goods, the Buyer must protect and not disclose their login details to any third parties.

    3. Rights and Duties of the Buyer
    3.1. The Buyer is entitled to buy goods at the nukas.lt e-shop following the procedures set out in the Terms and Conditions and other information sections of this e-shop.
    3.2. The Buyer undertakes to accept the goods ordered and pay the agreed price.
    3.3. If the Buyer’s details provided in the registration form change, the Buyer must update them at once.
    3.4. The Buyer undertakes not to pass on their login data to third parties. If the Buyer loses their login details, they must at once inform the Seller about that.
    3.5. By using the nukas.lt e-shop, the Buyer agrees to the Terms and Conditions and undertakes to follow them and not to violate the legislation of the Republic of Lithuania.

    4. Rights and Duties of the Seller
    4.1. The Seller undertakes to enable the Buyer to effectively use the services provided at the nukas.lt e-shop.
    4.2. If the Buyer tries to undermine the stability and security of the nukas.lt e-shop or violates their obligations, the Seller is entitled to restrict, suspend, or terminate the Buyer’s access to the nukas.lt e-shop immediately and without notice.
    4.3. The Seller undertakes to respect the Buyer’s right to privacy regarding the Buyer’s personal information provided in the registration form of the nukas.lt e-shop and not to transfer it to third parties.
    4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.

    5. Ordering Goods, Prices, Payment Procedure, and Terms.
    5.1. The Buyer can buy online at the nukas.lt e-shop 24/7.
    5.2. The contract comes into force when the Buyer clicks the ‘Confirm Order’ button when buying online. Upon receipt of the order, the Seller confirms the order by sending a confirmation e-mail to the e-mail address specified by the Buyer.
    5.3. The prices of the products at the nukas.lt e-shop is indicated in euros, including VAT.
    5.4. The Buyer can pay for the goods using e-banking or PayPal payment system by transferring the money to the settlement account of the nukas.lt e-shop. In this case, the responsibility for data security rests with the respective bank, the e-banking system, which is used for monetary transactions. The Buyer can also pay by bank transfer, by transferring the money to the bank account of the e-shop.
    5.5. The Buyer undertakes to pay for the goods immediately. The goods are packed, and the delivery term is initiated only after payment for the goods has been received.
    5.6. If the Buyer fails to make payment within 48 hours, the order will be cancelled.

    6. Delivery of the Goods
    6.1. The Buyer undertakes to specify the exact place of delivery of the goods by selecting the delivery service while placing the order.
    6.2. The Buyer undertakes to accept the goods in person. Suppose the Buyer is unable to accept the delivery in person, while the Goods have been delivered to the address indicated. In that case, the Buyer is not entitled to any claims against the Seller for delivering the Goods to the wrong entity.
    6.3. The goods are delivered by the Seller, the Seller’s authorised representative (courier service) or collected by the Buyer at the specified nukas.lt store, depending on the method of delivery chosen by the Buyer.
    6.4. The Seller may apply delivery discounts if the Buyer exceeds the default order amount.
    6.5. The Seller delivers the goods to the Buyer under the terms specified in the descriptions of the goods. In exceptional cases, the delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In this case, the Seller undertakes to contact the Buyer immediately to agree on delivery terms.
    6.6. In all cases, the Seller is exempt from liability for breach of the delivery terms of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or circumstances beyond the Seller’s control.
    6.7. The Buyer must immediately inform the Seller if the goods are delivered in damaged packaging. The consignment contains unordered goods or the wrong quantity of goods, or the delivered order is incomplete.
    6.8. If the Buyer notices any damage to the packaging at the time of delivery, the Buyer must note the damage on the delivery note provided by the courier or draw up a separate damage report. The Buyer must do this in the presence of the courier. Failure to do so exempts the Seller from liability to the Buyer for damage to the Goods in respect of damage to the packaging not noted by the Buyer in the courier’s delivery note.

    7. Quality and Warranty of the Goods
    7.1. Each item sold at the nukas.lt e-shop is specified in the description of the goods.
    7.2. The Seller is not responsible for any mismatch of the colour, shape, or other parameters of the goods at the nukas.lt e-shop with the actual size, shape, and colour of the goods due to the display properties used by the Buyer.
    7.3. The Seller may grant an additional higher discount for certain groups of goods, which may have a shorter validity period, and be subject to other terms and conditions specified in the descriptions of such goods.

    8. Returns and Exchanges
    8.1. Returns are carried out following Order No 217 of the Minister for Economy of the Republic of Lithuania of 29 June 2001 approving the Rules for Returning and Exchanging Items. In all cases, money for returned goods is paid only to the payer’s bank account.
    8.2. The Buyer must send the returned goods by registered mail or by a courier service of their choice. The Buyer will pay the postage costs of returning or exchanging the goods.
    8.3. The Buyer may return the goods within 14 (fourteen) days from the date of delivery of the goods to the Buyer by informing the Seller by e-mail and filling in a special form for the exchange and return of goods, indicating the name of the goods to be returned, the order number, and the reasons for return.
    8.4. The returned goods must be in their original packaging, in good condition, undamaged, unused, in the same condition as when the Buyer received them and must not have lost their original appearance (intact labels, sealed protective film, etc.). This does not apply in the case of returns of faulty goods. The Buyer provides proof of purchase when returning the goods.
    8.5. The Seller is entitled not to accept the Buyer’s returns if the Buyer does not follow the return procedure set out in Clause 8.3.
    8.6. If faulty goods or goods of inadequate quality are returned, the Seller undertakes to accept such goods and replace them with similar suitable goods.
    8.7. Should the Seller not have goods suitable for replacement, the Buyer is refunded the paid amount, including delivery price.
    8.8. If the Buyer paid for the goods with a gift voucher, the voucher and the other paid amount will be refunded.
    8.9. If the Buyer returns goods bought during a promotion, the amount paid for the item (after discount) will be refunded.
    8.10. If the Buyer was entitled to free delivery at the time of purchase, the delivery costs in case of return are deducted from the total amount paid by the Buyer, applying the delivery rates in force at the time.

    9. Liability of the Buyer and the Seller
    9.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. Suppose the Buyer does not provide exact personal data in the registration form. In that case, the Seller is not held liable for the consequences thereof and is entitled to claim direct damages from the Buyer.
    9.2. The Buyer is responsible for the actions carried out using the nukas.lt e-shop.
    9.3. Once registered, the Buyer is responsible for transmitting their login data to third parties. If a third party uses the services provided by the nukas.lt e-shop, the Seller considers this person to be the Buyer.
    9.4. The Seller is exempt from any liability where the loss is caused by the Buyer’s failure to read the Terms and Conditions, despite the Seller’s recommendations and the Buyer’s obligations when allowed to do so.
    9.5. If the nukas.lt e-shop managed by the Seller contains links to the e-sites of other companies, institutions, organisations or persons, the Seller is not responsible for the information or activities contained therein, as the Seller does not supervise, control, or represent those companies and persons.

    10. Promotion terms and conditions
    10.1. The Seller may arrange various promotions at the e-shop nukas.lt at their own discretion.
    10.2. The Seller is entitled unilaterally modify or cancel the promotion terms and conditions without a separate notification. Any modification or cancellation of the promotion terms and conditions is valid from the moment of such modification of cancellation.
    10.3. Following the legislation of the Republic of Lithuania, the promotion discounts are not applicable to initial or special milk formula.
    10.4. The discounts cannot be accumulated.
    10.5. The quantity of goods is limited; therefore, due a high demand, the promotional goods may be sold out before the end of the promotion period. In that case, the promotional goods are offered for sale until their stock is finished or the promotion period ends.
    10.6. If the prices or other information indicated at this e-shop are different from those indicated in the promotional banners, this is a mistake. Please contact the administration of UAB "Nukas".
    10.7. We recommend not to postpone your purchases for later. Please keep in mind that the goods in the cart and their prices are not reserved.

    11. Marketing and Information
    11.1. The Seller may, at their sole discretion, run various promotions on the nukas.lt e-shop.
    11.2. The Seller is entitled to unilaterally change the promotion terms and cancel the promotion campaigns without prior notice. Any modification or cancellation of the terms and conditions of the promotions take effect from the moment of modification or cancellation.
    11.3. The Seller sends all notifications by the means of communication indicated in the Buyer’s registration form.
    11.4. The Buyer sends all notifications and questions to the telephone numbers and e-mail addresses indicated in the ‘Contact’ section of the e-shop managed by the Seller.
    11.5. The Seller is not liable if the Buyer does not receive the information or confirmation messages sent due to internet disruptions, network disturbance of the e-mail service providers, or incorrect data provided by the Buyer.

    12. Final Provisions
    12.1. These Terms and Conditions have been drawn up following the laws and regulations of the Republic of Lithuania.
    12.2. Any disagreements arising from applying the Terms and Conditions are settled by negotiation. If the parties hereto fail to reach an agreement, the disputes are settled following the procedure set up by the law of the Republic of Lithuania.
